Terms of Use and Privacy Statement

Website Terms of Use
These Website Terms of Use apply to the Ashburton Trading Society Limited’s (ATS) website.  By using ATS’s website you acknowledge and accept these Website Terms of Use.
ATS reserves the right to amend its Website Terms of Use at any time without notice.  Any amendment to its Website Terms of Use will take effect when it is published on its website.

ATS Website Content
Every effort has been made to ensure that the information published on ATS’s website is up to date and accurate.  However, ATS does not represent or warrant that any information published on ATS’s website is up to date or accurate or that any such information is suitable for your intended use.  Information on the ATS website is of a general nature only and is not intended for any particular person. 

Passwords
Any passwords allocated to you or inputted by you to access any information (including account information) are to be held securely by you.  You must exercise all possible care to prevent disclosure of your password to any other person.  In particular, you must not keep a written record your password.  ATS is not responsible or liable for the security of your password or for any access to the ATS website resulting from the unauthorised use of your password.
ATS retains the right to disable your password or prevent you from accessing the ATS website without notice if it considers it to be necessary to maintain the integrity or security of the ATS website.

System Integrity
ATS uses its reasonable endeavours to ensure the availability of the ATS website, subject to any downtime required for maintenance or other reasons outside ATS’s control.  However, ATS takes no responsibility for any system unavailability or for any loss that is incurred as a result of the ATS website or any services provided on the ATS website being unavailable.  Furthermore, ATS does not assume any responsibility for the corruption of any data or information held by ATS.

Data
ATS’s servers have security certificates so all data transferred between you, and ATS’s server is encrypted. However, the internet is not in itself a secure environment. You should only enter, or instruct the importation of, data to the ATS website within a secure environment. This means that your browser must support the encryption security used in connection with ATS’s servers.
The Company stores your data in the location the Company considers will give you the most efficient access from wherever in the world you may be.  However, access and storage controls via the ATS website are administered by ATS in New Zealand as the holder of that data.
Where you input data from somewhere other than the country where the data is stored or to be stored, you consent to that data being transferred from one country to the other (including via any intermediate country) as a function of transmission across the internet.

Third Party Websites
ATS may provide on its website from time to time links to third party websites.  These websites are outside the control of ATS.  You visit any linked website at your own risk.  The inclusion of any link on the ATS website does not imply any endorsement by ATS of that website or the information appearing there on or any of the products or services described thereon.  ATS is not responsible for the content, validity, accuracy, safety or use of any other website.

Copyright
ATS’s website and its content are protected by copyright and ATS reserves all of its rights except as set out in these Website Terms of Use.  No part of ATS’s website may be reproduced or adapted in whole or in part without the prior consent of ATS. 
Some material on ATS’s website, including trademarks and logos, is the intellectual property of third parties.  Your rights in relation to that material are as defined by that third party.
You may print or temporarily store information from this site for your personal use only, in limited quantities.  Any copyright notice on that information must be retained on your copy.  You are not permitted to incorporate anything from this site in any other work, including, in particular, republishing it for any commercial or other purpose.

Indemnity
You agree to indemnify and hold ATS harmless for any loss or damage suffered by ATS for any claim or action brought against ATS resulting from your use and/or misuse of the ATS website.

Limitation of Liability
Your use of the ATS website is at your own risk.  Subject to any terms implied by law which cannot be excluded, ATS shall not be responsible or liable, in contract, tort (including negligence), equity or otherwise for any direct, indirect, incidental, consequential, special or punitive damage, or for any loss of profit, income or savings, or any costs or expenses incurred or suffered by your or any other person arising out of, or in connection with, your access to, or use of, the ATS website or any linked websites.

No Waiver
If ATS does not exercise or enforce any rights available to it under these Website Terms of Use it does not constitute a waiver of those rights.

Partial Invalidity
If any provision of these Website Terms of Use becomes or is held to be invalid, unenforceable or illegal for any reason, or in any respect, that provision shall be severed from the remaining Website Terms of Use which shall continue in full force and effect.

Governing Law
These Website Terms of Use and ATS’s website are governed by New Zealand law.

Privacy Statement
This Website Privacy Statement applies to the Ashburton Trading Society Limited’s (ATS) website.  By using ATS’s website you acknowledge and accept the terms of this Website Privacy Statement.
ATS reserves the right to amend its Website Privacy Statement at any time without notice.  Any amendment to its Privacy Statement will take effect when it is published on its website.

Collection and use of information
ATS may collects information from you when you access and use ATS’s website.  The type of information that ATS collects, and whether or that information is personal information, will depend on the facilities that you use on the ATS website and whether or not you are a ATS Shareholder, Sub-account holder, supplier or otherwise.
If you do not logon to any part of the ATS website, ATS’s system will record the date and time of your visit to the ATS website, the pages viewed and any information downloaded.  However, ATS’s systems will not record any personally identifiable information, unless you specifically submit personal information to ATS.  Any such personal information provided to ATS will be used for the purposes for which you provided it.
If you logon to any part of the ATS website, ATS may collect any personal information submitted by you for the purposes set out in the:
  • ATS Terms and Conditions if you are a ATS Shareholder or Sub-account holder; and/or
  • any agreement that you have entered into with ATS if you are a supplier.
Any personal information collected at ATS’s website is held by the Ashburton Trading Society Limited (97 Burnett Street, Ashburton 7700).  You are entitled to access, and request correction of, your personal information held by these organisations.
The ATS website may contain links to the websites of third parties.  If you have accessed third party websites through the ATS website ATS may also collect or have access to that information as part of its arrangements with those third parties.  ATS takes no responsibility for the privacy practices or content of any third party websites.

Cookies
ATS utilises "cookies" and other technical measures which enable the Company to monitor traffic patterns and to serve you more efficiently if you revisit ATS’s website.  A cookie does not identify you personally or contain any other sensitive information about you, but it does identify your computer. You can set your browser to refuse cookies or notify you when you receive a cookie and this will provide you with an opportunity to either accept or reject it in each instance. However, ATS utilises cookies for authentication and cookies will need to be enabled to use certain features of the website and the website may not function properly without the aid of cookies.

Web Analytics
The ATS website uses Google Analytics, a web analytics service provided by Google, Inc. (Google). Google Analytics uses "cookies” to help the website analyse how users use the site.  The information generated by the cookie about your use of the website (including Your IP address) will be transmitted to and stored by Google on servers in the United States.  Google will use this information for the purpose of evaluating your use of the ATS website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.  Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf.  You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of the ATS website. By using the ATS website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

Google AdWords
The ATS website uses the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to ATS’s website. It could mean that ATS advertise to previous visitors who haven't completed a task on ATS’s website.  This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Any Data collected will be used in accordance with ATS’s own privacy policy and Google's privacy policy.
